Terms of Service

These Terms are B2B SaaS terms for GP practices and authorized staff using Digitale Balie.

1. Introduction and parties

Digitale Balie provides a digital request-intake platform for GP practices. The service is used by the practice/organization and authorized users such as assistants, practice managers, GPs, and backoffice staff.

2. Eligibility and authority

  • The signup user confirms they are authorized to create a trial for the practice.
  • Provided information must be accurate and must not impersonate another practice.
  • Patient-facing use may require verification or approval by Digitale Balie.

3. Free trial

  • The free trial lasts 30 days from workspace creation or activation.
  • No automatic paid subscription starts unless agreed separately.
  • After the trial, the service may be limited or suspended unless continuation is agreed.
  • Digitale Balie may extend, suspend, or end a trial.
  • Portal integration is not included by default.

4. Verification before real patient use

A trial workspace can be created self-service. The GP practice is responsible for checking patient-facing text, phone routes, opening hours, and emergency instructions before sharing the page.

An unverified trial workspace must not be used for real patient requests unless Digitale Balie permits it.

5. Service description

  • Configurable patient frontdesk and request intake forms.
  • Assistant dashboard, response templates, archive, analytics, and practice administration.
  • Optional portal routing and optional portal integration by separate agreement.

6. What the service does not do

  • No AI triage, diagnosis, medical advice, or urgency decision-making.
  • No emergency handling and no guarantee that requests are handled within medical timeframes.
  • No replacement of GP, assistant, HIS, or patient portal.
  • The GP practice remains responsible for patient communication and clinical decisions.

7. Emergencies

The service is not for urgent or life-threatening situations. Patients must call the practice emergency line, out-of-hours GP service, or 112 as appropriate.

8. Practice responsibilities

  • Configure correct phone numbers, opening hours, emergency instructions, and patient-facing text.
  • Monitor staff and requests appropriately and define internal workflows/response times.
  • Ensure use complies with healthcare and privacy obligations.
  • Do not ask patients for BSN through the platform and do not use it as a medical triage tool.
  • Maintain account security and remove users who no longer work for the practice.

9. Accounts, security, and acceptable use

  • Accounts may not be shared and credentials must be kept confidential.
  • Digitale Balie may suspend suspicious or abusive accounts.
  • Users may not attack, reverse engineer, bypass access controls, send spam, submit unlawful content, or use another practice's identity.

10. Portal integration and templates

Portal integration is off by default. Simple portal routing may be configured; deeper portal or HIS integration requires a separate agreement. Digitale Balie does not guarantee third-party portal availability.

Response templates help assistants copy consistent replies. Templates are not automatically sent unless future functionality explicitly enables this; the practice remains responsible for review.

11. Data protection

The Privacy Notice applies. Where Digitale Balie processes patient data on behalf of the practice, the DPA applies. The GP practice is controller for patient request data; Digitale Balie is processor. Digitale Balie may be controller for account, marketing, support, and security data.

12. Availability, support, and continuation

The free trial is provided best effort without a formal SLA. Support is best effort by email. After the trial, continuation and terms are agreed separately; no automatic charge applies unless agreed.

13. Suspension and termination

Digitale Balie may suspend service for security risk, misuse, legal/privacy risk, impersonation, unverified use, or non-payment after a paid agreement. The practice may request termination; export/deletion follows retention policy and the DPA.

14. Intellectual property and confidentiality

Digitale Balie owns the platform, software, and design. The practice remains responsible for its own content and configuration. Confidential information, request data, and platform settings must remain confidential. Feedback may be used to improve the service.

15. Liability

Digitale Balie is not liable for medical decisions, practice failure to monitor/respond, third-party portals, or indirect damages. For the free trial, liability is limited as far as legally allowed. This clause should be legally reviewed before final use.

16. Changes, law, and contact

These Terms may be updated. Dutch law applies and competent courts in the Netherlands have jurisdiction. Contact: office@thepadel.pl.
